The “Save Our Bacon Act” sounds harmless—but it’s a federal preemption clause quietly tucked into the House Farm Bill that would gut more than 600 state laws covering animal welfare, food safety, and disease control.
In 2018, over 60% of California voters passed Prop 12, banning the extreme confinement of mother pigs in cages so small they can’t turn around or stretch their legs. Massachusetts, Florida, Arizona, and Ohio followed with similar laws. The pork industry sued twice to stop it—and lost twice, all the way up to the Supreme Court, which ruled states have the right to set standards for products sold within their borders.
Now Big Pork is trying to override the votes of more than 13 million Americans by burying this provision in must-pass legislation. A Harvard Law School analysis warns it could wipe out hundreds of state laws, including disease-control measures that protect public health.
Family farmers who invested in higher-welfare facilities would lose the level playing field these laws created. Five giant meatpacking companies win. Everyone else—voters concerned about cruelty, farmers, and consumers—loses.
The Senate is next. If senators—especially those on the Senate Agriculture Committee—hear from enough constituents, the Save Our Bacon provision can be stripped from the Farm Bill before it ever reaches the floor.
