Republicans in the Ohio state House just passed the so-called “Indecent Exposure Modernization Act,” their latest targeted attack on LGBTQ+ Ohioans.
Disguised as some sort of commonsense “update” to already existing indecency laws, Ohio HB 249 singles out "performers or entertainers who exhibit a gender identity that is different from the performer's or entertainer's biological sex using clothing, makeup, prosthetic or imitation genitals or breasts, or other physical markers.”
This language is intentionally vague and has nothing to do with updating indecency statutes or keeping kids safe from predators or sex offenders. It is a de facto drag ban, written in deliberately hazy terms to give law enforcement broad discretion to harass the LGBTQ+ community and criminalize gender-nonconforming Ohioans for daring to be themselves and live their daily lives.
Tell the Ohio state Senate to kill the “Indecent Exposure Modernization Act!”
Indecent exposure is already illegal in Ohio. This bill doesn't fill a gap — it creates one big enough to drive a steamroller through. Furthermore, courts have consistently held that drag, dance, fashion, and performance art are protected under the First Amendment. HB 249 doesn't modernize Ohio law; it weaponizes it.
